Terms of Service

1. General Provisions and Service Nature

The Zůstalo.cz classifieds platform is operated by the entity identified in the header of this page. The platform serves the Czech market, enabling users to list and discover construction materials, renovation surplus, and tools.

Zůstalo.cz is an intermediary platform. We are not a seller or buyer of items listed, we do not take part in contracts concluded between users, and we charge no commissions on transactions. Sale or donation agreements are entered into solely between the users.

2. Free Service

Account registration, browsing, and standard listing publication are free of charge for both private individuals and businesses.

The operator charges no commissions, success fees, or listing fees for standard classifieds.

3. Payments and No Checkout

Zůstalo.cz does not operate an online shopping cart (checkout), payment gateway, or financial escrow system.

Users negotiate payment and handover terms directly. Transactions in the Czech Republic are priced in Czech Korunas (CZK) or offered free for collection.

We strongly recommend in-person handover and inspection of goods on site prior to payment. Never transfer money in advance to unknown parties or submit payment card credentials through links sent in messages.

4. User Account and Security

Registration requires a valid email address that the user has the legal right to access.

Users must safeguard their login credentials and one-time verification codes. Accounts are non-transferable. Notify support immediately in case of suspected unauthorized access.

5. Listing Rules, Edits, and Photos

Listing authors bear full responsibility for the accuracy and completeness of their listings, disclosing the real condition, quantities, and known flaws of materials.

By uploading photos, the user confirms they hold the necessary rights. Our processing pipeline automatically strips EXIF metadata and GPS location coordinates from photos to protect privacy.

Editing a listing overwrites the previous publicly displayed text; price adjustments are recorded in the public price history. The operator maintains an internal audit log of edits with timestamps and IP addresses for fraud prevention and consumer protection.

Commercial sellers (businesses and sole proprietors) must provide accurate legal identification (company registration, registered address) and adhere to applicable consumer protection legislation.

6. Prohibited Content and Behavior

Listing stolen goods, hazardous waste (including asbestos in violation of waste management laws), hazardous chemicals, weapons, counterfeits, or items infringing third-party rights is strictly forbidden.

Spam, phishing, fraud, abusive behavior, and interfering with platform operations are strictly prohibited.

7. Craftsmen Directory (Handymen / Tradespeople)

The platform allows craftsmen to maintain a professional profile and users to send inquiries. The operator acts solely as an inquiry transmission intermediary.

The operator is not responsible for the quality, timeliness, or performance of work carried out by tradespeople. Any contract for work is concluded directly between customer and craftsman.

8. Content Moderation and Reporting (DSA)

In accordance with the Digital Services Act (DSA), the operator reserves the right to remove listings or suspend accounts that violate these terms or applicable laws.

Users may report suspicious or unlawful content using the “Report a problem” button on listing pages or via /podpora. Affected users receive a statement of reasons and an opportunity to appeal.

9. Account Closure and Data Retention

Users may request account deletion at any time in their account settings. Following a 30-day grace period, the account and listings are removed from live databases, and an evidence package (account data, logs, listings and photos, without message content) is preserved in a secure non-public archive for 12 months for statutory claims defense and official legal requests.

After 12 months, the archived records are permanently and automatically deleted.

10. User content, liability and changes to these terms

By posting a listing you grant the service a free, non-exclusive permission to display its content and photos on the site, in search results and in sharing channels for as long as it is published. You remain the author and are responsible for having the right to use the content.

The operator only mediates contact and does not verify every listing. It is not responsible for the quality, legality or availability of the materials offered or for users' conduct, except for liability that cannot be excluded by law. The operator may remove content or block an account that breaches these terms and will tell the user why.

The operator may change these terms for important reasons (change of law, of service features); we announce material changes on the site or by e-mail at least 14 days in advance. Continued use after that date means acceptance of the change.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic.

Consumer disputes may be submitted for out-of-court settlement to the Czech Trade Inspection Authority (Česká obchodní inspekce – ČOI), Štěpánská 567/15, 120 00 Prague 2, https://www.coi.cz, or via the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
